5 Transmission of Data Abroad
We are entitled to transmit your data to countries other than Switzerland, in particular countries of the European Union and countries outside the European Union, also countries that do not guarantee an adequate level of data protection equivalent to that in the EU or Switzerland.

In case of a request for deletion of your data, we will delete them unless we are required to retain them under a legal or contractual obligation. In particular, we reserve the right to delete or restrict the processing of data necessary for asserting claims related to the customer’s contractual relationship only after the expiration of the respective limitation and forfeiture periods as far as there is no legal or contractual obligation for us to retain such data.

Unless explicitly stated when collecting the data, the provision of data is neither necessary nor compulsory. If you do not provide us with data we necessarily require, we are not in the position to enter a contractual relationship with you and you may not benefit from our services.
9 Further Information About Data Protection
9.1 Data Processing in Connection with the Booking, Payment and Use of a Service
Processing your data is necessary for the provision of our services (in particular the organization and realization of excursions). When you make use of our services or book an excursion, we will in particular process the following personal data: name, first name, nationality, e-mail address, telephone number, gender, information about whether the person is an adult, a child or an infant as well as your booking agency or any information you may share with us at your own request. Such data will, inter alia, be required for the booking of excursions, attendance checks at excursions as well as reservation of seats and/or any services of third parties, such as hotels or activities.
When paying for the service via credit card, the credit card details are also required for payment processing. In this case, credit card details are not processed by Best of Switzerland Tours AG. Payment is made directly through established payment service providers depending on the booking platform:
- Online booking: Payment is made through the online payment system provided by TrekkSoft/Payyo.
- Booking by telephone or e-mail: Payment is effected via our payment provider Datatrans. We will send you a payment link by e-mail through which you may trigger payment yourself. Should you not have internet access, you may, upon request and at your own risk, also transmit your credit card details to us by telephone. In this case, we will directly enter such information on the platform of Datatrans and trigger payment. In doing so, we will neither record nor store your credit card details.
- Booking directly at our departure point: Payment is made in cash, through the payment terminal provided by Six Payment Services or SwissCard, or via the booking application of TrekkSoft/Payyo.
The privacy policy of the respective payment providers pursuant to section 4 (payment providers) applies. Best of Switzerland Tours AG does not assume any liability for the processing of your data and compliance with data protection law by the respective payment providers.
9.2 When Using Our Website (https://www.switzerland-tours.ch)
9.2.1 Creation of Log Files and Use of Cookies
When accessing our website, our system automatically collects data and information from the calling computer system (known as log files). Additionally, we use cookies on our website. Cookies are small files that are stored on the user’s computer when using the website, allowing us to recognize your browser during the next session. Through analysis cookies, we gain insights into how the website is used, enabling us to optimize our offering, make the website more user-friendly, and improve its quality. These data are analyzed by the provider Matomo, and statistics about the visitors to our website are generated with the following information.
Information regarding the search engines used, search terms used, languages used, origin of the visitors by countries, browsers used and their plugins, operating system, number of visits, date and time of visits, referrers, duration of visit and which pages were visited, entrance and exit pages, cancellation rates, IP addresses, etc.
The user data thus collected will be pseudonymized by technical measures. Therefore, the allocation of the data to the calling user is no longer possible. The data are not stored together with other personal data of the user.
The data will also be stored in the log files of our system. No further storage of these data together with other personal data of the user will take place.
The data will be deleted as soon as the respective session has been finished. Further storage is possible; in this case, the users' IP addresses will be deleted or anonymized in order to render allocation to the calling user impossible.
Depending on the browser settings selected, cookies are accepted automatically. Generally, however, you can set your browser so that the storage of cookies is deactivated, or you are notified when a cookie is placed. If you do not accept cookies, this may reduce the functionality of our website.
9.2.2 Use of Analytic Tool “Google Analytics”
We use the service of Google Analytics of Google LLC in the U.S.A. By using cookies, this service allows us to analyze the use of our website. For this purpose, the information generated by the cookie, such as your anonymized IP address, will be transmitted to, stored on and evaluated by, a server of Google LLC that may also be located in the U.S.A. TrekkSoft is a Swiss software agency based in Interlaken. Information about data protection in connection with the use of services of TrekkSoft and Payyo (in particular the booking and paying of tours) can be obtained from the privacy statement on the website of TrekkSoft.
We do not assume any liability for the processing of data and compliance with applicable data protection regulation and any privacy policies by TrekkSoft.
10 Data Security
We take adequate technical and organizational security measures as far as reasonable to protect your data from unauthorized access, loss and destruction.
Within the visit of our website, we use the SSL method (Secure Socket Layer) in connection with the highest encryption supported by your browser. E-mails/contact forms are not encrypted because we assume that you will not transmit any confidential data to Best of Switzerland Tours AG via these media.
